Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and RoadReady LLC ("RoadReady," "Punkin," "we," "us," or "our"), located in Salem, Oregon, USA, governing your access to and use of the Punkin mobile application and any related services (collectively, the "Service").
By downloading, accessing, or using Punkin, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Punkin. By using the Service, you represent that you meet this requirement and, if you are between 13 and the age of majority in your jurisdiction, that you have your parent or guardian's permission to use the Service and that they have reviewed these Terms.
Punkin is available worldwide. You are responsible for ensuring your use of the Service complies with the laws of the jurisdiction from which you access it.
2. The Service
Punkin is a meal-planning and nutrition-coaching application that helps you plan meals, track macros, manage a kitchen/pantry, generate grocery lists, and interact with an AI-powered assistant ("Ask Punkin") for meal recommendations and food-related questions. Features may include allergy filtering, macro/calorie tracking, recipe recommendations, grocery intelligence, and voice/photo-based interactions with Ask Punkin.
We may add, modify, or remove features at any time, and some features may be limited to paid subscription tiers as described in Section 5.
3. Accounts
To use most features of Punkin, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration and onboarding (including allergy, dietary, and health-adjacent information you choose to provide)
- Keep your login credentials confidential and secure
- Notify us promptly at support@punkin.app if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
You may sign in using Sign In with Apple or other supported authentication methods. You may delete your account at any time directly within the app (My Punkin → Settings → Delete Account) or through our account deletion page.
4. User Content
"User Content" means any information, data, photos, messages, or other content you submit to Punkin, including pantry items, allergy and dietary preferences, chat messages and photos sent to Ask Punkin, saved recipes, and progress logs.
- You retain ownership of your User Content.
- By submitting User Content, you grant RoadReady a limited, non-exclusive, royalty-free license to use, store, and process that content solely to provide and operate the Service for you (for example, generating a meal plan or an Ask Punkin response), consistent with our Privacy Policy.
- You are solely responsible for the accuracy of the information you provide, including allergy and dietary information. Punkin's allergy-filtering feature relies entirely on the accuracy of what you input — see Section 9 ("Health & Safety Disclaimer") below.
- You agree not to submit User Content that is unlawful, infringing, abusive, or that violates the rights of any third party.
5. Subscriptions & Purchases
Punkin offers free features as well as optional paid subscription tiers ("Premium") that unlock additional functionality. Subscriptions are processed through the Apple App Store or Google Play billing systems and managed in part through RevenueCat. Punkin subscriptions are only available for purchase through the Apple App Store or Google Play Store — we do not offer a separate web-based checkout or subscription option.
- Billing: Subscription prices, billing frequency, and any free-trial terms will be presented to you at the time of purchase through the applicable app store.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date, in accordance with Apple's and Google's respective billing policies.
- Cancellation: You may cancel your subscription at any time through your Apple ID account settings or Google Play account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds for unused time.
- Refunds: All purchases are subject to the refund policies of the Apple App Store or Google Play Store, as applicable. RoadReady does not directly process payments or issue refunds; refund requests must be made through Apple or Google.
- Price Changes: We may change subscription pricing at any time. Any price changes will be communicated in advance and will apply to subsequent billing periods, consistent with applicable app store requirements.
- Feature Gating: Premium features (for example, certain Kitchen/Grocery or personalization capabilities) are gated based on your live subscription status at the time of use. Losing Premium status (e.g., through cancellation or lapse) may immediately restrict access to those features.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to Punkin's systems, other users' accounts, or non-public areas of the Service
- Reverse-engineer, decompile, or disassemble the app, except where permitted by law
- Use automated means (bots, scrapers) to access the Service without our prior written consent
- Upload malicious code, or content that is unlawful, defamatory, obscene, or infringing
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use Ask Punkin to attempt to extract, manipulate, or misuse the underlying AI system
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Ask Punkin (AI Features)
Ask Punkin uses a third-party AI service provider to generate conversational responses, meal recommendations, and answers to food-related questions based on the information you provide (see our Privacy Policy for details on how this data is processed).
- Ask Punkin's responses are generated automatically and may occasionally be inaccurate, incomplete, or inappropriate.
- Ask Punkin is advisory only — it does not take actions on your behalf outside of the conversation (e.g., it will not place grocery orders or modify your account without your explicit action).
- You should use your own judgment before relying on any recommendation, and you are responsible for independently verifying anything related to your health, safety, or dietary needs (see Section 9).
8. Recipe & Nutrition Data
Punkin's recipe and nutrition information is maintained through an internally controlled recipe and ingredient database. While we aim for accuracy, nutrition values, ingredient lists, and allergen information are provided for general informational purposes only and may contain errors, omissions, or be affected by variations in specific products, brands, or preparation methods.
9. Health & Safety Disclaimer — No Medical Advice
PUNKIN IS NOT A MEDICAL DEVICE OR SERVICE, AND NOTHING IN THE APP CONSTITUTES MEDICAL, NUTRITIONAL, OR DIETARY ADVICE FROM A LICENSED PROFESSIONAL.
- Meal plans, macro/calorie calculations, recipe suggestions, and allergy-filtering features are informational and organizational tools only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
- Allergy filtering is a safety-assistive feature, not a guarantee. It depends entirely on the accuracy of the information you provide and the accuracy of our underlying recipe/ingredient data, both of which may contain errors.
- You are solely responsible for verifying that any food, recipe, or ingredient is safe for your specific allergies, medical conditions, or dietary needs before consuming it. Always check actual product labels, ask restaurant staff directly, and consult a qualified healthcare provider — especially in the case of severe or life-threatening allergies.
- If you have a medical condition, food allergy, or specific health goal, consult a physician, registered dietitian, or other qualified healthcare professional before making decisions based on Punkin. Do not disregard, avoid, or delay professional medical advice because of anything provided through the Service.
- In an emergency, call 911 (or your local emergency number) immediately — do not rely on Punkin.
10. Intellectual Property
Punkin, including its name, logo, design, software, and all related content (excluding your User Content), is owned by RoadReady LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use, subject to these Terms. All other rights are reserved.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or attempt to extract the source code of the app, except as permitted by applicable law.
11. Third-Party Services
The Service relies on third-party providers, including Supabase (backend infrastructure), RevenueCat (subscription management), Apple and Google (app distribution, billing, and authentication), and a third-party AI service provider (Ask Punkin). Your use of the Service is also subject to the applicable terms of those providers where relevant (for example, Apple's or Google's app store terms). We are not responsible for the acts or omissions of these third-party providers, though we take reasonable steps to select and use reputable service providers.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, engaged in unlawful conduct, or for any other reason, including discontinuation of the Service.
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including Sections 9, 10, 13, 14, and 15) will survive.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Any nutrition, allergen, recipe, or AI-generated information will be accurate, complete, or reliable
- Any errors in the Service will be corrected
Your use of the Service is at your own risk.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROADREADY LLC AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY HEALTH-RELATED OUTCOME RESULTING FROM RELIANCE ON MEAL, RECIPE, MACRO, OR ALLERGEN INFORMATION PROVIDED THROUGH THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROADREADY LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ROADREADY LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless RoadReady LLC, its officers, employees, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any User Content you submit, including inaccurate allergy or dietary information you provide.
16. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws principles, except where superseded by applicable consumer protection laws in your jurisdiction of residence.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@punkin.app. If a dispute cannot be resolved informally within 30 days, you and RoadReady LLC agree that any legal action shall be brought exclusively in the state or federal courts located in Marion County, Oregon, and you consent to the personal jurisdiction of those courts, except where prohibited by local law (for example, certain consumer protections in the EU/UK/California may entitle you to bring claims in your local jurisdiction notwithstanding this clause).
Class Action Waiver: To the extent permitted by applicable law, you agree that any proceedings to resolve disputes will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
17. Changes to the Service or These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you through the app or other reasonable means before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
We may also modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
18. Export Control & Sanctions Compliance
You agree to comply with all applicable export control and economic sanctions laws, and you represent that you are not located in, under the control of, or a national or resident of any country or region subject to U.S. government embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties.
19. Apple & Google-Specific Terms
If you downloaded Punkin from the Apple App Store or Google Play Store, the following additional terms apply:
- These Terms are between you and RoadReady LLC only, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content.
- Apple and Google have no obligation to furnish maintenance or support for the Service.
- Apple and Google are not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, or claims arising under consumer protection law.
- Apple and Google are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
- You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
20. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and RoadReady LLC regarding the Service and supersede any prior agreements.
